Welcome to MANN. MANN is operated by BRANDCOM TALENT, INC. The terms “MANN,” “we,” “us,” and “our” refer to BRANDCOM TALENT, INC, doing business through the MANN website, store, and related services.

MANN operates this website and online store, including all related information, content, features, tools, products, and services, to provide customers with a curated shopping experience. MANN is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, including our Privacy Policy, Shipping Policy, Return Policy, and any other policy posted on our website, describe your rights and responsibilities when you visit, browse, use, or purchase from MANN.

Please read these Terms carefully. They include important information about your legal rights and cover areas such as order acceptance, product availability, partner-supplied products, shipping and delivery, returns and final sale items, warranty disclaimers, and limitations of liability.

By visiting, interacting with, using, or purchasing through our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.

You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide this information.

MANN offers a curated mix of products, which may include MANN-branded products, products from authorized brand partners, products supplied by third-party vendors, distributors, resale partners, or fulfillment partners, and products sourced through lawful resale channels.

We make reasonable efforts to present product information accurately, including descriptions, images, pricing, availability, sizing, ingredients, materials, and other details. However, we do not guarantee that product descriptions, images, colors, packaging, availability, or other content will always be complete, current, or error-free. Product appearance may vary based on your screen, device, lighting, manufacturer updates, packaging changes, or supplier-provided information.

All product descriptions, pricing, availability, shipping details, and promotions are subject to change at any time without notice. We reserve the right to discontinue any product, limit quantities, refuse orders, or restrict sales to any person, geographic region, or jurisdiction at our sole discretion.

Certain products may be subject to additional terms, restrictions, supplier policies, warranty limitations, final sale terms, shipping restrictions, or return limitations. These may vary depending on whether the product is a MANN-branded product, partner-supplied product, third-party fulfilled product, resale item, limited-release item, promotional item, personal care product, or item marked final sale.

Brand Partnership, Marketplace, and Reseller Disclaimer

MANN may be an authorized dealer, retailer, affiliate, partner, or approved seller for certain brands or products offered on our platform. Where such a relationship exists, we may identify it on the relevant product page, brand page, or marketing material.

For brands or products where MANN does not have an official dealer, retailer, partnership, sponsorship, or endorsement relationship, MANN operates as an independent reseller or marketplace seller. Unless expressly stated by MANN, the appearance of a brand, trademark, logo, product name, image, or other brand identifier on the Services does not imply affiliation, sponsorship, authorization, endorsement, or approval by the applicable brand owner.

All third-party trademarks, logos, product names, brand names, and related intellectual property belong to their respective owners and are used for product identification, compatibility, description, or resale purposes only.

For non-MANN products, partner-supplied products, resale items, marketplace items, or products fulfilled by third parties, original manufacturer warranties, brand warranties, return rights, packaging standards, authentication methods, customer support channels, or replacement options may not apply or may differ from those offered by the original brand, vendor, distributor, resale partner, or fulfillment partner.

Section 3 - Orders

When you place an order through MANN, you are making an offer to purchase the items in your order. MANN reserves the right to accept, decline, cancel, limit, or modify any order for any reason, including but not limited to product availability, suspected fraud, pricing or listing errors, supplier issues, resale restrictions, shipping limitations, payment issues, or order risk concerns.

Your order is not accepted until MANN confirms acceptance. We must receive and process your payment before your order is accepted. An order confirmation email does not necessarily mean that your order has been accepted, fulfilled, or shipped.

Please review your order carefully before submitting it. Once an order is accepted, sent to fulfillment, or processed by a vendor, distributor, resale partner, or fulfillment partner, we may be unable to cancel or change it.

If we cancel, decline, modify, or are unable to fulfill an order, we will attempt to notify you using the email address, billing address, shipping address, or phone number provided at the time of purchase. If payment has already been captured for an order that is canceled before fulfillment, we will issue a refund for the canceled item or order in accordance with applicable law.

You represent and warrant that your purchases are for personal or household use and not for unauthorized commercial resale, export, marketplace arbitrage, or any unlawful purpose.

Section 4 - Prices, Billing, and Promotions

Prices, discounts, promotions, shipping rates, and product availability are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed, unless there is a pricing, listing, technical, or availability error.

Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, import charges, duties, or other fees. Final charges, including applicable taxes and shipping, will be shown at checkout before you place your order.

For non-MANN products, partner-supplied products, resale items, marketplace items, or third-party fulfilled products, prices and shipping rates may vary based on vendor, distributor, resale partner, fulfillment partner, product availability, location, order value, package size, and shipping method.

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. If an order is affected by a material pricing or listing error, we may cancel the order and issue a refund for the affected item.

Promotions, discounts, store credits, gift cards, special offers, and limited-time offers may be subject to separate terms. If there is a conflict between these Terms and the terms of a specific promotion, the promotion terms will govern for that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through MANN. You agree to promptly update your account and other information, including your email address and payment information, so that we can complete your transactions and contact you as needed.

You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorized to use such payment method for the purchase; (iii) charges incurred by you will be honored by your payment provider; and (iv) you will pay charges incurred by you at the posted prices, including shipping, handling, and all applicable taxes, if any.

Section 5 - Shipping and Delivery

MANN currently ships within the United States only. At this time, we do not offer international shipping.

Shipping rates, processing times, delivery estimates, shipping methods, and shipping restrictions may vary by product, vendor, distributor, resale partner, fulfillment partner, carrier, order value, package size, delivery location, and shipping method.

Eligible MANN-branded products may have different shipping rates and delivery estimates than non-MANN products, partner-supplied products, resale items, marketplace items, oversized items, limited-release items, or products fulfilled by third parties. Final shipping costs will be shown at checkout before you place your order.

All delivery dates and shipping timelines are estimates only and are not guaranteed. Business days do not include weekends or holidays. Processing and delivery may take longer during high-volume periods, product launches, promotions, holidays, supplier delays, carrier disruptions, weather events, or other circumstances outside our control.

Because some orders may include products from different vendors, distributors, resale partners, fulfillment partners, or shipping locations, your items may arrive in separate packages and on different delivery dates. You may receive separate tracking information for different parts of your order.

To the fullest extent permitted by law, MANN is not responsible for delays caused by carriers, weather, incorrect shipping addresses, vendor delays, distributor delays, resale partner delays, fulfillment partner delays, service interruptions, holidays, customs or regulatory issues, or other events outside our reasonable control.

If there is a significant delay with your order, contact us at customers@mann.shop and we will help review the status. Where required by applicable law, we will provide delay notices, cancellation options, or refunds for unshipped merchandise.

Section 6 - Returns, Refunds, Exchanges, and Final Sale Items

Purchases made through MANN are subject to our Return Policy, which is incorporated into these Terms by reference.

Not all products are eligible for return, refund, or exchange. Return eligibility may vary by item and may depend on whether the product is a MANN-branded product, partner-supplied product, resale item, marketplace item, third-party fulfilled product, discounted item, promotional item, limited-release item, personal care product, hygiene-related product, or item marked final sale.

For products that are not made by MANN, including products supplied by third-party brands, vendors, distributors, resale partners, or fulfillment partners, return eligibility may be determined by the applicable brand, vendor, distributor, resale partner, or fulfillment partner policy.

Products marked final sale, certain discounted or promotional items, personal care products, grooming products, hygiene-related products, opened or used items, select clothing, resale items, limited-release items, custom products, special-order products, and gift cards may not be eligible for return, refund, or exchange unless required by law or unless the item arrives damaged, defective, or incorrect.

A return request does not guarantee approval. Items sent back without prior return authorization may not be accepted or refunded.

Section 7 - Product Use, Personal Care, and Safety

You are responsible for using all products safely, appropriately, and in accordance with any instructions, warnings, labels, ingredient lists, manufacturer guidance, or product information provided.

For personal care, grooming, skincare, fragrance, hygiene, wellness, or body-related products, you should review all ingredients and warnings before use. Discontinue use if irritation or an adverse reaction occurs. MANN does not provide medical advice, and information on the Services is for general informational and shopping purposes only.

If you have allergies, sensitivities, medical conditions, or specific health concerns, consult a qualified professional before using any relevant product. To the fullest extent permitted by law, MANN is not responsible for misuse of products, failure to follow product instructions, allergic reactions, sensitivities, or individual results.

Section 8 - Intellectual Property

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, design, selection, and arrangement, are owned by MANN, its affiliates, partners, or licensors and are protected by U.S. and foreign patent, copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent.

Except as expressly provided in these Terms, nothing grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of MANN, Shopify, or any third party. Unauthorized use of the Services may violate federal, state, and international intellectual property laws. All rights not expressly granted are reserved by MANN.

MANN’s names, logos, product and service names, designs, and slogans are trademarks of MANN or its affiliates or licensors. You must not use such trademarks without prior written permission from MANN. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

Section 9 - Optional Tools

You may be provided with access to customer tools offered by third parties as part of the Services. We do not monitor, control, or have input over those third-party tools.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement. We shall have no liability arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the Services is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider.

We may also offer new features through the Services in the future, including the release of new tools and resources. Such new features will also be deemed part of the Services and subject to these Terms of Service.

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating the content, accuracy, policies, or practices of any third-party materials or websites you choose to access. If you decide to leave the Services to access third-party materials or websites, you do so at your own risk.

We are not liable for any harm or damages related to your access of third-party websites, or your purchase or use of any products, services, resources, or content on third-party websites. Please review third-party policies and practices carefully before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.

Section 11 - Relationship with Shopify

MANN is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with MANN.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MANN, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MANN.

Section 12 - Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify’s privacy practices.

Because the Services are hosted by Shopify, Shopify may collect and process personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit through the Services may be transmitted to and shared with Shopify and other third parties that help us operate the Services, process payments, fulfill orders, provide customer service, perform analytics, or support our business operations.

We may use this Feedback to operate, provide, evaluate, enhance, improve, and promote the Services, products, and MANN brand.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback complies with these Terms.

We are under no obligation to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback.

We may, but have no obligation to, monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, objectionable, or in violation of any party’s intellectual property rights or these Terms.

You agree that your Feedback will not violate any right of any third party, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary right. You further agree that your Feedback will not contain unlawful, abusive, obscene, false, misleading, or malicious content, or any computer virus or malware that could affect the operation of the Services or any related website.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Feedback. You are solely responsible for any Feedback you submit and its accuracy. We take no responsibility and assume no liability for Feedback posted by you or any third party.

We are not obligated to update, amend, or clarify information on the Services except as required by law.

• To spam, phish, pharm, pretext, spider, crawl, or scrape; or

To the fullest extent permitted by law, MANN disclaims all warranties and conditions, express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, non-infringement, accuracy, availability, and uninterrupted service.

For non-MANN products, partner-supplied products, resale items, marketplace items, or third-party fulfilled products, any applicable manufacturer, supplier, distributor, brand, reseller, or fulfillment partner warranty may be limited, unavailable, or subject to that third party’s own terms.

Some jurisdictions do not allow limitations or exclusions of certain warranties, so some of the above exclusions may not apply to you.

Section 18 - Limitation of Liability

To the fullest extent permitted by law, MANN, BRANDCOM TALENT, INC, our directors, officers, employees, affiliates, partners, vendors, distributors, resale partners, fulfillment partners, contractors, service providers, licensors, and Shopify and its affiliates will not be liable for any indirect, incidental, punitive, special, consequential, exemplary, or similar damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, loss of goodwill, or business interruption.

This limitation applies to claims arising out of or related to your use of the Services, inability to use the Services, any product purchased through the Services, shipping or delivery issues, vendor or partner delays, product availability, product use, third-party websites, errors or omissions, or any other claim related in any way to the Services or products.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Section 19 - Indemnification

You agree to indemnify, defend, and hold harmless MANN, BRANDCOM TALENT, INC, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, vendors, distributors, resale partners, fulfillment partners, licensors, and service providers from any losses, damages, liabilities, claims, or expenses, including reasonable attorneys’ fees, payable to any third party due to or arising out of:

• Your breach of these Terms of Service or the documents they incorporate by reference;
• Your violation of any law or the rights of a third party;
• Your access to or use of the Services;
• Your misuse of any product purchased through the Services; or
• Your fraud, misrepresentation, or unauthorized activity.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify you will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld. To the fullest extent permitted by law, you and MANN agree that any dispute, claim, or proceeding arising out of or relating to these Terms, the Services, or any purchase made through the Services will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction and venue of those courts.
